OFFICIAL RULES for ‘Which Medical Device – Device of the Year 2012 - competition for submitting a nomination’
By participating in this competition, entrants agree to be bound by these Official Rules and by the decisions of the Which Medical Device judging panel, which are final in all matters relating to this competition.
No purchase or payment of any kind is necessary to win. A purchase will not improve your chances of winning.
ELIGIBILITY: The competition is open to all those who complete the nomination form and are at least 18 years of age. Void where prohibited or restricted by law. All employees of SAGE and Which Medical Device and their immediate families (spouse, parent, sibling or child or their respective spouses) or those residing in the same households of employees, whether related or not, are not eligible to enter or to win. The competition is subject to all applicable laws. The winner is responsible for all taxes, if any, applicable to prize awarded.
TIMING: The survey will start 28th October 2012 and will end 31st December 2012 (the “Entry Period”).
HOW TO ENTER: Nomination forms completed as instructed during the Entry Period will have the reason for nominating a medical device considered by the Which Medical Device judging panel. Limit to one (1) entry per device, per person. After the first nomination submission for a particular device, additional nomination submissions for the same device will not result in additional entries.
PRIZE DETAILS: A Kindle Fire will be awarded to the entrant whose reason for nominating a device, is considered, by the Which Medical device judging panel, to be the best reason. The judges decision may not be questioned and is final.
The prize will be awarded by Which Medical Device, to one (1) winner selected from all eligible entries received during the Entry Period. Which Medical Device may, at its discretion, substitute a prize of equal or greater value in the event the stated prize is unavailable. The prize cannot be substituted, redeemed for cash or transferred.
DRAW AND AWARDING OF PRIZES: Judging will take place within fifteen (15) days after the end of the Entry Period. The winner will be notified via email within ten (10) days of the date of the draw. Entrants need not be present to win. Non-winning entries from this draw will not "roll-over" into draws held in the future by the Which Medical Device. The potential winner may be required to execute and return an affidavit of eligibility, a liability release and, where legal, a publicity release within fourteen (14) days of prize notification. In the event of noncompliance with this time period, with these Official Rules or if prize or prize notification is returned as undeliverable, prize may be forfeited and awarded to an alternate winner.
ODDS OF WINNING: Odds of winning depend on the number of eligible entries received during the Entry Period.
GENERAL CONDITIONS: Entry constitutes permission for Which Medical Device and its designees to use each winner's name and location and/or likeness for advertising, promotional, and other purposes in any and all media now or hereafter known throughout the world in perpetuity, without further compensation, notification and permission, except where prohibited by law, and the prize winner agrees to confirm such permission in writing promptly upon request. IN NO EVENT WILL THE SPONSOR, ITS RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES, DEALERS, DISTRIBUTORS, SUPPLIERS, PRIZE PROVIDER AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES AND AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS COMPETITION OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE. Any and all disputes, claims and causes of action arising out of or connected with this competition or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all claims, judgments and awards shall be limited to actual out-of pocket costs incurred, including costs associated with entering this draw, but in no event legal fees. If for any reason the draw is not capable of running as planned, including for reasons of tampering, unauthorised intervention, fraud or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the draw, Which Medical Device reserves the right at its sole discretion to cancel, terminate, modify and/or suspend the draw and to disqualify any individual who tampers with the entry process, violates these Official Rules, or acts in a disruptive manner. In the event the competition is terminated, Which Medical Device reserves the right to award the prize in a random draw from among all eligible, non-suspect entries received for the applicable draw up to time of such action.
LIABILITY: Which Medical Device and its respective subsidiaries, affiliates and advertising, promotion and production agencies, and their respective officers, directors, employees, representatives and agents are not responsible for lost, late, incorrect, incomplete, stolen, garbled, misdirected, undelivered or delayed entries or for entries not received by the specified deadline; or for printing, distribution, production, technical, human or other errors relating to or in connection with the draw, including, without limitation, errors in any advertising materials, the administration of the draw, the processing of entries or the announcement of the prizes.

JURISDICTION: The draw and these Official Rules shall be governed by and construed in accordance with the laws of England, UK.
